3. Rate Changes

  • For all HTS codes listed as “New Products Covered by Section 338 Tariffs” in the AUTO Annex Part A and Alcohol Scope Modification Annex Part A, the applicable additional duty is:
  • New rate: 50% ad valorem Section 338 tariff on Canadian-origin goods (in addition to any normal MFN/other duties and applicable trade remedies, if any).
  • Old rate: Previously not subject to this 50% Section 338 duty (only standard tariff treatment applied).
  • For all HTS codes listed in the “Products No Longer Covered by Section 338 Tariffs” sections, the change is:
  • Old rate: 50% ad valorem Section 338 tariff on Canadian-origin goods.
  • New rate: 0% additional Section 338 duty (reverts to standard tariff treatment; any other applicable duties remain).
  • For all HTS codes listed in the Alcohol, Dairy, and Motor Vehicles Annexes as “excluded from importation,” the change is:
  • Old status: Admissible subject to applicable duties (including any prior Section 338 tariffs where relevant).
  • New status: Importation of Canadian-origin goods under these HTS codes is prohibited (import ban). Duty rate is effectively moot because entry is not permitted.

  • Flag any active purchase orders, contracts, or in-transit shipments involving these HTS codes from Canada.

2) Confirm HTS classification:

  • Re-validate HTS classifications for affected products, especially where scope limitations (e.g., “Packaged,” container size, value per liter, specific notes) apply.
  • Where classification is uncertain, seek binding rulings or guidance from CBP.

B. For Products Now BANNED from Importation

  • Immediately cease placing new orders from Canada for:
  • Alcohol HTS codes listed in Alcohol Annex I.
  • Dairy/whey/molasses/non-alcoholic beer HTS codes listed in Dairy Annex I.
  • Motorcycles over 800 cc under 8711.50.00 from Canada.
  • For in-transit or on-the-water shipments:
  • Review effective date in the proclamations; if arrival will be on/after the effective date, coordinate with carriers and suppliers on diversion, return, or alternative sourcing.
  • Prepare for potential exclusion from entry and possible re-export or destruction if goods arrive after the ban is effective.
