Section 338 Canada scope changes October 30: 22 codes lose the 50% duty and 100 additional codes become subject to 50%.
CBP is implementing the October 23, 2026 Presidential Proclamation modifying Section 338 duties on Canadian goods. Effective October 30, 2026, 22 specified HTSUS classifications are removed from the 50% additional duty under 9903.03.14, while 100 additional classifications become subject to the 50% duty. Brokers must update entry logic, review Canadian imports, and apply the applicable Chapter 99 reporting.
CBP is implementing further modifications to the Section 338 additional duties imposed on certain products of Canada. For goods entered for consumption or withdrawn from warehouse for consumption on or after October 30, 2026, 22 listed HTSUS classifications will no longer be subject to the 50% additional ad valorem duty under HTSUS 9903.03.14. The affected classifications include 1212.21.00, 3920.20.00, 3923.10.90, 4412.33.06, 4819.10.00, 8418.69.01, 8422.40.91, and 8433.60.00, among others.
