A new Section 232 Proclamation imposes 10–50% additional ad valorem duties on specified aluminum, steel, copper articles and derivatives from all countries, implemented through HTS 9903.82.02–9903.82.17 effective April 6, 2026. Duty treatment varies by origin (e.g., UK, Russia, column 2), metal content thresholds, and melt/smelt location, with some 0% lines and rate floors (10%/15%). This CSMS implements a new Section 232 Proclamation that significantly restructures and expands additional duties on imports of aluminum, steel, and copper articles and their derivatives from all countries. The measures are implemented through new and revised Chapter 99 provisions, HTSUS 9903.82.02–9903.82.17, plus continued application of 9903.85.67 and 9903.85.68 for Russian aluminum and derivatives.

Scope and thresholds

The Proclamation applies to specific HTS lines listed in annexes and in the Metals HTS LIST 040326 attachment. Goods listed as articles or derivatives of more than one metal are subject to only one of the applicable duty rates. Goods in the annexes that contain no aluminum, steel, or copper are not subject to these duties. For goods in the annexes (other than those in Chapters 72, 73, 74, and 76), if the aggregate weight of the applicable metal(s) is less than 15% of the total weight, they are not subject to the additional duties and instead fall under 9903.82.03 at 0%. The applicable metals for the 15% calculation are defined by HTS classification in annex IV; metals not specified for a given HTS are excluded from the calculation.

Key Chapter 99 provisions and rates

  • 9903.82.02 (50%): Applies broadly to articles of aluminum, steel, or copper and derivative aluminum or steel articles as defined in U.S. note 16(c)(i)-(v), except where superseded by 9903.82.14, 9903.85.67, or 9903.85.68.
  • 9903.82.03 (0%): Applies to covered articles (excluding Ch. 72–76) where the weight of the applicable metal(s) is less than 15% of the article’s weight. When using this provision, filers must report the aggregate weight of the applicable metal(s) in kilograms as a second quantity on the entry line.
  • 9903.82.04 (25%): Applies to aluminum or steel articles and derivatives that are products of the United Kingdom, where at least 95% of the aluminum was smelted or most recently cast in the UK or at least 95% of the steel was melted and poured in the UK, per U.S. note 16(c)(i)-(iv) and (d).
  • 9903.82.05 (15%): Applies to derivative aluminum or steel articles that are products of the UK meeting the same 95% UK melt/smelt criteria under U.S. note 16(c)(vi)-(vii) and (d).

Provisions 9903.82.06–9903.82.09 cover certain copper articles and derivative aluminum and steel articles, with strict 95% U.S. melt/smelt requirements:

  • 9903.82.06 (10%): Applies to copper articles and derivative aluminum and steel articles under U.S. note 16(c)(ii), (iv), (vi)-(viii) and (e), except where superseded by 9903.82.15 or 9903.85.68.
  • 9903.82.07: Applies to derivative aluminum and steel articles under U.S. note 16(c)(ix)-(x) and (e). For articles with a column 1 duty rate below 10%, the total duty (column 1 plus additional) must equal 10%. If the base rate is already 10% or more, 9903.82.07 does not apply; instead, 9903.82.08 governs.
  • 9903.82.08: Applies to the same derivative aluminum and steel articles as 9903.82.07. For articles with a column 1 duty rate of 10% or higher, no additional duty is due.
  • 9903.82.09 (25%): Applies to copper articles and derivative aluminum and steel articles under U.S. note 16(c)(vi)-(viii), except where superseded by 9903.82.16 or 9903.85.68.

Provisions 9903.82.10–9903.82.12 address derivative aluminum and steel articles that do not meet the 95% U.S. melt/smelt requirement:

  • 9903.82.10: Applies to such derivatives under U.S. note 16(c)(ix)-(x) and (f). For articles with a column 1 duty rate below 15%, the total duty (column 1 plus additional) must equal 15%.
  • 9903.82.11: Applies to the same derivatives as 9903.82.10. For articles with a column 1 duty rate of 15% or higher, no additional duty is due.
  • 9903.82.12 (25%): Applies to derivative aluminum and steel articles that are products of countries listed in general note 3(b) (column 2 countries), under U.S. note 16(c)(ix)-(x), except where superseded by 9903.82.17 or 9903.85.68.

Special cases:

  • 9903.82.13 (0%): Applies to articles meeting U.S. note 16(c)(vi)-(viii) that are motorcycle parts in Chapters 84, 85, or 87 for use in U.S. motorcycle manufacturing, exempting them from additional Sec. 232 duties.
  • 9903.82.14 (50%): Applies to steel or copper articles and derivative steel products of the Russian Federation under U.S. note 16(c)(iii)-(v).
  • 9903.82.15 (10%): Applies to copper and derivative steel products of Russia under U.S. note 16(c)(iv), (vii), (viii) and (e).
  • 9903.82.16 (25%): Applies to copper and derivative steel products of Russia under U.S. note 16(c)(vii)-(viii).
  • 9903.82.17 (25%): Applies to derivative steel articles of Russia under U.S. note 16(c)(x).

Russia aluminum duties remain governed by:

  • 9903.85.67 (200%): Aluminum articles that are products of Russia or that use any primary aluminum smelted in Russia or are cast in Russia.
  • 9903.85.68 (200%): Aluminum derivative articles meeting the same Russian smelt/cast criteria.

Products subject to 9903.85.67 or 9903.85.68 cannot be reported under 9903.82.03.

Effective dates and future changes

The additional duties under 9903.82.02–9903.82.17 apply to goods entered for consumption, or withdrawn from warehouse for consumption, on or after 12:01 a.m. ET on April 6, 2026. Headings 9903.82.07, 9903.82.08, 9903.82.10, 9903.82.11, and 9903.82.12 apply from April 6, 2026, through December 31, 2027. For goods entered on or after January 1, 2028, the goods currently covered by those headings will instead be subject to the duty rates under 9903.82.05, 9903.82.06, and 9903.82.09; CBP will issue additional guidance before that date.

Origin and melt/smelt reporting

Brokers must continue to report countries of melt and pour for all subject steel and steel derivatives and countries of smelt and cast for all subject aluminum and aluminum derivatives, following prior CSMS instructions. CBP will later require reporting of copper smelt and cast for imports under HTS 8544.42.10, 8544.42.20, 8544.42.90, and 8544.49.10 once ACE functionality is available.

Interaction with FTZ and Chapter 98/99

Covered products admitted into U.S. foreign trade zones on or after April 6, 2026, must be admitted in privileged foreign status (unless eligible for domestic status). Privileged foreign-status goods will be subject to the applicable Sec. 232 ad valorem rates when entered for consumption. For Chapter 98 entries, goods remain eligible for those provisions, but for subheading 9802.00.60, Sec. 232 duties must be assessed on the full value of the imported article. No claim may be made under any Chapter 99 provision that would reduce or eliminate duty for goods subject to these additional duties, and all ADD/CVD and other charges remain applicable.

Operational implications

Customs brokers and importers must update classification and origin data to identify all HTS lines mapped to 9903.82.02–9903.82.17, determine applicable metal content and melt/smelt locations, and apply the correct Chapter 99 codes and additional duty rates starting April 6, 2026. Special attention is required for UK and Russian origin goods, low-metal-content articles, motorcycle parts, and products with low base MFN rates where the new provisions create minimum total duty levels of 10% or 15%.
