HTS 3822 Diagnostic Reagents: Where Heading 3822 Ends and Chapter 30 Begins

When is a reagent heading 3822, and when is it Chapter 30?
Heading 3822 covers diagnostic or laboratory reagents on a backing and prepared diagnostic or laboratory reagents, whether or not in kits, other than those of heading 3002 or 3006, plus certified reference materials. That exclusion in the heading text is the whole boundary: before 3822 can apply, you must clear Chapter 30, and the clearing question is one test.
The Patient-Administration Test: a diagnostic reagent designed to be administered to the patient, swallowed, injected, or otherwise introduced into the body, such as an opacifying preparation for radiological examination, classifies in subheading 3006.30 under Chapter 30. A reagent that does its diagnostic work outside the body, on a blood draw, a swab, a slide, or a lateral-flow device, stays in heading 3822. Immunological products like antisera and blood fractions classify in 3002 on what they are, regardless of lab use.

What NY N256882 teaches about reagent kits
In NY N256882 (February 5, 2015), CBP classified an iron-assay reagent set imported in bulk from Canada, two components sold to work together. The holding split them: the color reagent, the component that actually performs the diagnostic reaction, went to heading 3822 at a free rate of duty, while the companion dissociating reagent went to heading 3824 as a general chemical preparation, dutiable at 5 percent under the rates then in force.
Three lessons for anyone importing reagent lines:
- Bulk kills the kit. Components imported in bulk are classified individually; the retail-set analysis that might have carried both bottles into 3822 only becomes available when goods arrive put up together for retail sale.
- "Prepared diagnostic reagent" is a functional standard. The bottle that develops the diagnostic signal earned 3822; the helper chemistry did not.
- The spread is the stakes. Free versus dutiable on adjacent bottles in the same box is exactly the kind of line-level spread a duty audit later finds, in either direction.
A four-step decision sequence for reagent classification
- Chapter 30 first. Administered to the patient? Then 3006.30 territory. An immunological product or blood fraction? Then 3002, full stop, 3822's own text yields.
- Chapter 29 check. A separate chemically defined compound, a pure chemical merely used in a lab, generally belongs in Chapter 29, not 3822. "Prepared" in 3822 means a preparation: mixed, on a backing, or put up for diagnostic use.
- CRM claim. If the product is a certified reference material with the certificate to prove it, heading 3822 takes priority under Chapter 38's notes, document the certified values and traceability.
- Kit configuration. Components in bulk classify separately, per N256882; genuine retail sets trigger GRI 3(b) essential-character analysis, and the answer can differ shipment by shipment if your packaging does.
This is GRI 1 doing most of the work, heading texts and chapter notes, before GRI 3 ever enters.
